SD finally attends school - 18 school days after the year started
The good news is SD FINALLY attended her first day of school today, 18 school days after the school year already started.
The annoying news is it looks like unless the lawyer we are meeting with says otherwise, she is going to completely get away with it. CPS in her old state said they were closing the investigation because she was not a resident of that state anymore and then the new state said BM was not a resident of that state yet. BM very much played the gray area on this to get her way. The fact is we have confirmation from the school district is BM did not submit the enrollment application for SD until the day she returned from her honeymoon 14 days after the school year at the new school had already started. BM gave so many excuses that even the old school principal said BM has given a million different excuses at this point and it doesn't add up, telling DH this when DH called him last week, so it isn't just us.

This has to be incredibly frustrating. On the one hand, yay! she is actually enrolled now.
BUT.. she missed over 3 weeks equivalent of school.. a kid who struggles with academics already doesn't need to miss it.
I don't think that the fact that CPS in either state declined to charge her would prevent your husband from seeking full custody under the grounds that his child missed so much school.. but I'm sure that would have helped his case. His lawyer can see if it's worth the try.. or not. Clearly you have a lot of documentation re his Exes' less than stellar organization and planning.. and the educational lags the child experiences. but would that be enough..it's a toss up honestly.

It is beyond frustrating because we know BM has been lying and that she prioritized what she wanted (her wedding and then honeymoon) over SD and her sister's education. We said from the beginning our reason to call CPS was to try and force her hand to get SD enrolled faster. Did CPS being called do that? I don't know, but it does provide more documentation for if we need it. When DH followed up with BM again the excuse she originally told the CPS agent is different than what she was telling DH and then was different again when the CPS agent met with BM.
That is really what we are waiting on is the lawyer's opinion because clearly SD NEEDS to not miss school, but because of BM's actions she is starting her first week on the school's 5th week of school. Regardless we will be filing contempt because BM is not notifying DH as she is supposed to according to the CO about when SD is staying anywhere that is not BMs residence and BM also now "officially moved" according to her message in the app, but we still have not received the 30 day written mailed notice. Possibly a third thing too, but need to check with lawyer if have enough grounds for.
We are tired of BM thinking she can just do whatever she wants, so at the very least going to court for contempt.

Good luck with all of that, most courts will do everything they can to keep a child with the mother no matter how bad the situation is. My DH only got full custody after the third time Meth Mouth was arrested and even after that he had to go into court every three months to fight and prove he was still the better and more stable alternative to a freaking drug addict. Seven years of in and out of court and every time they would give Meth Mouth more custody as an incentive for her to clean up her act. Thankfully Spawn turned 18 and was free to go live and be with Meth Mouth in her happy little drug hovel.
